National Labor Relations Board issues
amended complaint against Central Michigan Community
Hospital
Mt. Pleasant, MI – The National Labor Relations
Board Region 7 has issued an amended complaint against
Central Michigan Community Hospital for additional
violations of the National Labor Relations Act.
The NLRB’s complaints were a result of their
investigation in response to charges being filed
by the Michigan Nurses Association, on behalf of
the Central Michigan Community Hospital Registered
Nurses Association (CMCHRNA).
The new allegations in the complaint state that
CMCH violated the Act by:
Promulgating and maintaining overly broad rules regarding
- “unauthorized access to hospital during or
after work hours”
- “unauthorized solicitation for any cause during
work hours or unauthorized distribution of literature
during work and/or in direct patient care areas.”
The Board filed a complaint against CMCH in March
of this year. Subsequently CMCH put new rules in place
effective June 9, 2006. However, the Board found that
CMCH’s new rules were still too broad.
The amended complaint includes two allegations involving
activities protected by the National Labor Relations
Act. First, CMCH “threatened to discontinue
an employee benefit because its employees were engaging
in activities protected by the Act.” CMCH also
violated the Act by disciplining the CMCHRNA President
because she assisted the union and because they wanted
to discourage other employees from engaging in protected
concerted activities. The complaint orders the hospital
to:
- Rescind all illegal rules and take corrective action
for any employees who were disciplined on the basis
of the illegal rules.
- Rescind the President’s discipline because
it was given illegally
- Post appropriate notices as required by law.
- Make employees whole for any loss of earnings and
benefits
The hearing on the NLRB complaint against Central
Michigan Community Hospital is scheduled for November
29, 2006
