Unfair labor practice charge filed
against Cheboygan Memorial Hospital
Cheboygan, MI – The Michigan Nurses Association
(MNA) filed an unfair labor practice charge against
Cheboygan Memorial Hospital (CMH) last week for
violations of 8(a)(1) and (5) of the National Labor
Relations Act. The Michigan Nurses Association represents
the 75 registered nurses at CMH.
The charge asserts that the Hospital failed to
bargain in good faith when it made a unilateral
change in mandatory terms and conditions of the
nurses’ employment, specifically related to
overtime.
“There are two negotiated methods of paying
overtime to RNs in our contract, and the Hospital
is attempting to eliminate one of them without negotiating
with the Union,” says Margaret Johnson, Staff
Council Chair.
“The Hospital revealed a grandfathering plan
it had already implemented at a recent arbitration
hearing. No explanation has been provided to the
nurses for why the Hospital didn’t bring up
this issue during the 2005 contract negotiations
or at any other time before unilaterally implementing
the change,” says Anita Szczepanski, Labor
Attorney for MNA.
The NLRB will investigate the charge and determine
if evidence of a violation of the Act exists within
the next few months.
